SECTION 01

AGREEMENT

By accessing or purchasing the Operator OS curriculum, you agree to these Terms of Service. If you do not agree, do not use the product.
"Operator OS" refers to the curriculum, associated materials, frameworks, decision rules, artifact templates, and reference documents made available through operatoros.co and the Kajabi platform. "SW Digital Consulting" and "we" refer to SW Digital Consulting, Inc. DBA The Operator OS.
By completing your purchase, you confirm that you have read, understood, and agreed to these Terms of Service, the Privacy Policy, and the Refund Policy.

SECTION 02

LICENSE TO USE

When you purchase Operator OS, you receive a personal, non-transferable license to access and use the curriculum materials for your own professional development and practice.

You may not:

• Share, sell, sublicense, or transfer your login credentials or access to others
• Reproduce, distribute, or republish curriculum content in any form, in whole or in part
• Create derivative works based on the curriculum for commercial distribution
• Use curriculum content to build competing products or services
• Screen-record or capture lessons for distribution outside the platform
  
• Create, sell, or distribute competing curricula, training products, course materials, workshops, coaching programs, or derivative works for commercial distribution that use substantially the same framework architecture, lesson sequence, terminology, or artifact templates as the Operator OS curriculum

This license does NOT prohibit you from:

• Applying the frameworks, systems, and tools in your own independent consulting practice — this is the intended use
• Teaching or discussing these frameworks with individual clients as part of your consulting engagements
• Referencing the Operator OS curriculum by name with attribution in your own content
  The curriculum and all associated materials are the intellectual property of SW Digital Consulting, Inc.

SECTION 03

ACCEPTABLE USE

You agree to use the platform and curriculum only for lawful purposes and in accordance with these terms. You will not use the platform to transmit harmful, offensive, or illegal content, or to interfere with the platform's operation.

SECTION 04

PAYMENT AND PRICING

All prices are listed in USD. Payment is processed through Stripe via the Kajabi platform. By completing a purchase, you authorize us to charge the payment method provided.
If you select a payment plan, you authorize recurring charges on the schedule specified at checkout. Failure to complete a payment plan may result in suspension of access until the balance is resolved.
Founding Operator pricing is available during the founding access period only. The price will change when the founding period closes. Founding members' access is not affected by subsequent price changes.

DISCLAIMER OF WARRANTIES

The Operator OS curriculum is provided for educational and informational purposes only. It is not legal, financial, accounting, or professional advice. Nothing in the curriculum creates a professional-client relationship of any kind.

The curriculum draws on the author's experience operating an independent consulting practice. Results from applying the frameworks, systems, and tools will vary based on individual circumstances, effort, market conditions, and context. We make no guarantees of specific outcomes, revenue, client retention, or business results.

THE CURRICULUM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

SECTION 07

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SW DIGITAL CONSULTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE CURRICULUM OR PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF OPERATOR OS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR ACCESS, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.
NOTHING IN THIS AGREEMENT LIMITS OUR LIABILITY FOR: (i) GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; (ii) FRAUD OR FRAUDULENT MISREPRESENTATION; (iii) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; OR (iv) ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

SECTION 08

INTELLECTUAL PROPERTY

All curriculum content, including lessons, frameworks, decision rules, artifact templates, and reference documents, is the intellectual property of SW Digital Consulting DBA The Operator OS and protected by copyright law.

"Operator OS," "Predictability is the product," and associated marks are proprietary to SW Digital Consulting DBA The Operator OS. You may not use these marks without written permission.

SECTION 09

TERMINATION

We may suspend or terminate your access to the curriculum for material breach of these Terms, including unauthorized sharing of credentials, reproduction or distribution of curriculum materials, or circumvention of platform access controls.

For curable breaches, we will provide 10 days' written notice and an opportunity to cure before termination. For non-curable breaches — including fraud, chargebacks filed without prior contact, or repeated unauthorized sharing after notice — termination may be immediate.

If termination occurs within the 30-day refund window, the 30-day guarantee remains available unless the breach itself involves fraud or chargeback abuse. Termination after the 30-day window forfeits any remaining payment plan obligations but does not retroactively refund amounts paid.

SECTION 10

GOVERNING LAW

These terms are governed by the laws of the State of Idaho, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ada County, Idaho.

SECTION 11

Third-party platform dependency

Access to the Operator OS curriculum depends on third-party platforms including Kajabi (hosting and delivery) and Stripe (payment processing). We are not liable for outages, service interruptions, or access issues caused by third-party platforms. We will make commercially reasonable efforts to restore access promptly in the event of disruption but do not guarantee uninterrupted availability.

CHANGES TO THESE TERMS

We may update these terms from time to time. We will notify current customers of material changes by email. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.
